Scheduling a delivery or pickup with Woodrum Construction LLC constitutes acceptance of the full Terms and Conditions set forth below.

 

PAYMENT METHODS

In an effort to continue to offer flexible payment options to our valued customers, we do offer credit card payments, however, a 3% fee will be charged for this service to cover our cost. Visa, Mastercard, Discover and AMEX are approved methods of payment.  We also offer ACH payments to our customers that do not incur a fee. 

 

RETURNED PAYMENTS

All returned customer payments will be charged a $35 fee.

WARRANTY

All goods are hereby sold and delivered “AS IS” and with no warranty unless seller and customer specifically agree otherwise in writing.

 

RECYCLED AGGREGATE MATERIAL (CRUSHED CONCRETE & RECYCLED ASPHALT)
•    Environmentally friendly and cheaper alternative to virgin material. Made from crushed concrete and or asphalt with sand or rock fines which may vary in size between 1-3/4 inch to dust fines for promotion of compaction.
•    Commonly used for compacted roads, substrate for patios, driveways, sidewalks, walkways, asphalt base, or building foundations.

 

RECYCLED MATERIAL MAY CONTAIN MESH, REBAR, REMNANTS AND MAY VARY IN SIZE AND COLOR DUE TO THE NATURE OF ITS PRODUCTION AND RECYLING PROCESS.

INDIVIDUAL AGGREGATE PRODUCT WEIGHTS VARY SIGNIFIACTLY DEPENDING ON MOISTURE CONTENT AT THE TIME OF DELIVERY.

 

Material Disclaimers:  Upon agreement to purchase the customer agrees to the disclaimers and full terms and conditions and assumes the liability of the delivery. The term “commonly used” in the product's description of the material are just suggestions of previous applications by customers. Please consult a licensed contractor or engineer and follow all building codes and regulations imposed by your local county, city, and state government.

Size Variance:  Acceptable allowance on material size and ratio is  +/- 10%.  Variation is due to the sieve mechanism and process used at the quarry or pit. 

 

Product Appearance: The actual product may seem darker or lighter than it appears in our website images and our samples due to material being derived from a natural product but also due to moisture content.

 

Guiding Volume:  Acceptable allowance for expected delivery volume is +/- 10%.  Larger orders, the overall variance will me minimized.  These variances are a result of the loading mechanisms and moisture content.

 

Liability & Indemnification:  After arrival at the delivery location provided by the customer, Woodrum Construction LLC will offload the materials in an area designated by the customer. The area must be safe for our equipment to maneuver without causing damage to our equipment or putting our driver at risk. An adequate offloading area needs to be on a stable, flat surface; IE: concrete, asphalt or flat stable soil free from debris with adequate overhead clearance. The customer understands that our equipment can exceed weights of 38 to 40 tons when fully loaded and Woodrum Construction LLC will not be held liable for any physical or monetary damages to any existing access ways/roads, structural integrity of the property, underground or overhead lines, utilities, or structures. The customer has agreed to assume all responsibility for any fines, damages, claims, or other liabilities that may arise due to the placement of the materials by Woodrum Construction LLC, such as without limitation, placing the materials (i) outside the property lines, (ii) on property belonging to the city or county (including county or city streets), (iii) on private property owned by someone other than the customer, and (iv) obstructing access to a property or entity belonging to any other person. The customer agrees that Woodrum Construction LLC has no obligation to ensure that materials do not compromise the public right-of-way. Further, the customer shall meet all costs arising from any loss of time incurred by Woodrum Construction LLC if the customer is not prepared to receive the material when WC arrives. WC reserves the right to charge a buyer fee of $50 for every 1/2 hour of delay following arrival. There will be no additional fees if a customer asks for us to spread the material from our tailgates; however, we cannot guarantee that it will be a uniform layer due to compaction or moisture content of material at time of delivery. Woodrum Construction is a full-service contractor that can provide materials and also offer professional spreading/grading services at an additional charge. Our crews are experienced equipment operators and are knowledgeable on the best practices required when dealing with recycled material. Customers that choose to move, spread, relocate, or maneuver the delivered material themselves, do so at their own risk and accept full liability. Any activities with personal or rented tractors, vehicles or heavy equipment following delivery by Woodrum Construction is the full responsibility and liability of the customer and Woodrum Construction LLC will not be held liable for any damage including, but not limited to, tires or track damage as a result of remnant material in the recycled products or other damage as a result of the customer’s spreading activities.  The customer further agrees to hold harmless Woodrum Construction LLC and their affiliates from any, and all actual or alleged claims, demands, liability, and/or loss, whether this is brought by an individual or another legal entity, or imposed by a court of law that may arise out of any acts or material and services provided by Woodrum Construction LLC and its affiliates. This indemnification shall apply to and include without limitation the payment of all penalties, fines, attorneys’ fees, and related costs and any reimbursements to Woodrum Construction LLC and its affiliates for all legal expenses.
